Terms of Service

1. Agreement to Terms
By engaging Ferrarix ("we", "us", "our") for any services, you ("client", "you") agree to be bound by these Terms of Service. These terms apply to all services provided by Ferrarix, including but not limited to web development, app development, AI solutions, SEO, design, automation, and consulting services.
2. Services
Ferrarix provides digital agency services as described on our website and in individual project proposals. The specific scope, deliverables, timeline, and pricing for each project are agreed upon in writing before work begins.
We reserve the right to refuse any project that does not align with our capabilities or values.
3. Express Delivery & Timelines
Ferrarix offers express delivery services (24–48 hour turnaround) for select project types. Express delivery is subject to the following conditions:
- Brief submission deadline: The project brief must be submitted and confirmed by 12:00 PM (noon) CET on the requested delivery day.
- Scope approval: The project scope must be reviewed and approved by Ferrarix before the express timeline begins. We reserve the right to determine whether a project qualifies for express delivery based on complexity and requirements.
- Client responsiveness: Express timelines require prompt client feedback. Delays in client responses (approvals, content, assets) will extend the delivery timeline accordingly.
- Scope changes: Any changes to the agreed scope after approval may reset the delivery timeline and may incur additional charges.
- Availability: Express delivery is subject to our current workload and availability. We will confirm availability upon receiving your brief.
Standard project timelines are estimated during the discovery phase and communicated in the project proposal. While we make every effort to meet agreed deadlines, timelines are estimates and not guarantees unless explicitly stated in writing.
4. Pricing & Payment
- All prices are quoted in Euros (EUR) unless otherwise stated.
- Prices listed on the website are starting prices ("from") and may vary based on project scope and complexity.
- A detailed quote will be provided before any work begins.
- Payment terms: 50% upfront before work begins, 50% upon completion and before final delivery, unless otherwise agreed in writing.
- For express delivery projects, full payment may be required upfront.
- Late payments may incur a fee of 1.5% per month on the outstanding balance.
5. Revisions & Amendments
All projects include unlimited revisions within the agreed scope. Revisions that fall outside the original project scope (additional features, pages, functionality, or significant design changes) will be quoted separately.
We define a "revision" as a modification to existing deliverables within the agreed scope. A "scope change" is a request for new deliverables or functionality not included in the original agreement.
6. Satisfaction & Refund Policy
We offer a 100% money-back guarantee on the initial deposit if you are not satisfied with the first milestone delivery, provided the refund is requested within 7 days of the first milestone presentation.
Refunds are not available for completed projects that have been approved by the client, or for work performed under express delivery after the brief has been approved and work has commenced.
7. Intellectual Property
- Upon full payment, all custom work produced for the client (designs, code, content) becomes the intellectual property of the client.
- Third-party tools, libraries, and frameworks used in the project remain subject to their respective licenses.
- Ferrarix retains the right to showcase the work in our portfolio and case studies unless explicitly agreed otherwise in writing.
- Any pre-existing intellectual property used by Ferrarix (templates, components, internal tools) remains the property of Ferrarix.
8. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the engagement. This includes business plans, technical specifications, customer data, and any information marked as confidential. This obligation survives the termination of the engagement.
9. Limitation of Liability
Ferrarix's total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project in question.
Ferrarix is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.
10. Hosting & Third-Party Services
Ferrarix may recommend or integrate third-party services (hosting, APIs, SaaS tools) as part of a project. We are not responsible for the availability, pricing, or terms of service of third-party providers. Ongoing subscription costs for third-party services are the responsibility of the client.
11. Termination
Either party may terminate the engagement with 14 days written notice. Upon termination:
- The client is responsible for payment for all work completed up to the termination date.
- All completed deliverables will be transferred to the client upon payment.
- Any unused prepaid amounts will be refunded, minus the cost of work already performed.
12. Communication & Response Times
We commit to responding to all client communications within 1 business hour during our working hours (Monday–Friday, 9:00–18:00 CET). Communications received outside working hours will be addressed on the next business day. Our 1-hour response guarantee applies to initial inquiries and active project communications only.
13. Governing Law
These terms are governed by and construed in accordance with the laws of the European Union. Any disputes arising from these terms shall be resolved through good-faith negotiation, and if necessary, through the competent courts of the jurisdiction in which Ferrarix is registered.
14. Changes to Terms
We reserve the right to update these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated terms.
